Korcula Experts Car Rental
Welcome to Korcula Experts. These Terms and Conditions (“Agreement”) constitute a legally binding contractual agreement between Korcula Experts (hereinafter referred to as the “Lessor”) and the person(s) signing the car rental agreement and/or completing the online booking process (hereinafter referred to as the “Renter”). By completing the online prepayment, the Renter declares to have reviewed, understood, and fully accepted this Agreement.
ARTICLE 1: DEFINITIONS & APPLICABILITY
1. "Vehicle" refers to the automatic automobile provided by the Lessor to the Renter for the duration specified in the Car Rental Agreement, including all tires, keys, equipment, accessories, and official vehicle documents.
2. "Authorized Driver" refers strictly to the main driver and any additional driver explicitly registered by name, date of birth, and driver’s license number on the first page of the rental agreement.
3. This Agreement applies to all vehicle rentals provided by the Lessor on the island of Korčula, Croatia. Any deviations, modifications, or verbal promises are legally invalid unless confirmed by the Lessor explicitly in writing.
ARTICLE 2: BOOKING, PAYMENTS, & CANCELLATION POLICY
1. A 30% online prepayment is required upon booking, with the remaining 70% balance due on-site at vehicle collection.
2. Cancellations made 7 or more days prior to pick-up receive a full prepayment refund minus a €30.00 administration fee.
3. Cancellations under 7 days or no-shows result in the forfeiture of the 30% prepayment.
ARTICLE 3: DRIVER REQUIREMENTS & AGE LIMITATIONS
1. Drivers must be at least 22 years old and hold a valid driver's license for a minimum of 2 years.
2. Young drivers (18–21) and senior drivers (71–80) are subject to a daily fee of €10.00 (capped at €80.00 per rental); young drivers must also upgrade to the Premium Insurance package.
3. Licenses in non-Latin characters require an International Driver’s Permit (IDP).
ARTICLE 4: SECURITY DEPOSIT & CURRENCY CONVERSIONS
1. A security deposit dependent on the car category and insurance package is pre-authorized on the Renter's credit card (Mastercard/Visa) upon vehicle collection and released after a damage-free return (typically 15 to 30 business days for funds to appear on bank statements).
2. All calculations are in Euros (€), using the official Croatian National Bank exchange rate for on-site conversions.
ARTICLE 5: INSURANCE COVERAGE & PACKAGES
1. START: Includes Third-Party Liability (TPL), Collision Damage Waiver (CDW), and Theft Protection (TP) with a maximum secure category deductible.
2. MEDIUM: Adds Super CDW (SCDW) and Personal Accident Insurance (PAI), significantly reducing the deductible but excluding tires, windscreens, and underbody damage.
3. PREMIUM: Provides comprehensive zero-excess protection including Windscreen, Lights, Tire Protection (WUG), and overhead/underbody coverage.
4. HARD INSURANCE EXCLUSIONS (WHEELS & RIMS): Standard Windscreen, Lights, and Tire Protection (WUG) only covers regular road puncture repairs, tire tread replacements from standard driving road hazards, and stone-chip glass damage. Any damage to wheel rims, alloy wheels, hubcaps, or tire sidewalls caused by scraping, scratching, or impacting curbs, sidewalks, parking barriers, or potholes is strictly excluded from ALL insurance packages (including MEDIUM and PREMIUM) and will be billed 100% to the Renter.
ARTICLE 6: ACCIDENTS, BREAKDOWNS, & PROCEDURES
1. Report any accident, theft, or vehicle defect immediately to the Lessor and the police (Phone: 192).
2. CRUCIAL: Failure to secure an official police report makes the Renter fully liable for the maximum deductible amount regardless of the insurance package purchased (including Medium and Premium packages).
3. Mechanical breakdowns through no fault of the renter include a local replacement vehicle subject to availability.
ARTICLE 7: VEHICLE USE & TRAVEL RESTRICTIONS
1. Driving on unpaved roads, macadam, gravel paths, dirt tracks, or beaches is strictly prohibited and voids all insurance, rendering the Renter 100% financially liable for all damages up to the full replacement value of the car.
2. Cross-border travel is strictly limited to direct neighbors of Croatia (Slovenia, Hungary, Bosnia & Herzegovina, Serbia, Montenegro) unless explicitly authorized in writing.
ARTICLE 8: KEY & PROPERTY MANAGEMENT
1. Keys must be kept secure and dry; swimming or entering the water with the key is prohibited. Water or saltwater damage is classed as a complete loss charged at dealer replacement cost plus a €30.00 administration surcharge.
2. Theft protection is completely voided if the vehicle is stolen and original keys cannot be presented to the office.
ARTICLE 9: CLEANLINESS, SMOKING & INTERIOR POLICY
1. Vehicles must be returned clean; excessive dirt, sand, mud, or upholstery stains from wet swimwear incur a fixed €75.00 deep-cleaning fee.
2. Smoking inside the vehicle is strictly prohibited and automatically triggers the same cleaning fee.
3. INTERIOR DAMAGE EXCLUSION: Any cigarette burns, tears, deep scratches, rips, or fluid/chemical stains to the seats (including leather or fabric), dashboard, roof lining, or interior door panels are completely excluded from all insurance packages, except when resulting directly from a formally registered and police-reported third-party collision.
ARTICLE 10: FUEL & MILEAGE POLICIES
1. Rentals operate on a Like-for-Like fuel policy; missing fuel levels incur local market rates plus a €40.00 refueling service charge.
2. Mileage is capped at 600 km per day (4,500 km monthly limit), with extra kilometers charged at €0.20 per km under our fair usage framework.
ARTICLE 11: PARKING TICKETS & TRAFFIC VIOLATIONS
1. The Renter is permanently and fully responsible for all traffic, speeding, and parking fines incurred during the rental period.
2. Forwarding renter contact details to official authorities for unpaid fines incurs a mandatory €30.00 administration surcharge per violation.
ARTICLE 12: AFTER-HOURS LOGISTICS & MEET & GREET
1. Pick-ups or returns outside standard operating hours (08:00–20:00) require prior agreement and a fixed €50.00 Out of Office Fee.
2. A company representative must be physically present during handover; leaving the vehicle unattended is strictly prohibited.
ARTICLE 13: FORCE MAJEURE & VEHICLE AVAILABILITY
1. The Lessor is not liable for performance failures, delivery delays, or vehicle non-availability caused by Force Majeure events or unforeseen circumstances beyond control.
2. Unavailable vehicles prompt a free upgrade to a larger category or a 100% refund of the online prepayment.
ARTICLE 14: LIMITATION OF LIABILITY
1. The total financial liability of the Lessor is strictly capped at the total rental amount paid under the specific agreement.
2. Indirect, incidental, or consequential damages (such as missed flights, delayed transfers, or lost holiday bookings) are fully excluded.
ARTICLE 15: INTELLECTUAL PROPERTY & TERMINATION
1. Website content, digital imagery, logos, and booking platform assets are protected intellectual property.
2. Material contract breaches entitle the Lessor to immediately terminate the agreement, repossess the vehicle at the renter's cost, and claim full damages.
ARTICLE 16: DATA PROTECTION (GDPR)
1. Personal data is processed in accordance with Art. 13 EU Regulation n. 2016/679 (GDPR) to manage rental services and assess future booking eligibility.
2. Data may be formally shared with local enforcement authorities, parking management companies, or debt recovery agencies if legally required.
3. Renters retain the legal right to access, modify, block, or request removal of their personal data records.
ARTICLE 17: JURISDICTION, CLAIMS & APPLICABLE LAW
1. This rental agreement is exclusively regulated and interpreted under Croatian Law.
2. Any legal disputes shall be settled exclusively in the Court of Dubrovnik, Croatia, preserving standard statutory consumer protections.
3. Any formal equipment or vehicle complaints must be submitted in writing within 30 days after the rental ends; claims outside this window will not be taken into consideration.
